An appeal having been taken to this Court from the order of the Supreme Court, New York County, entered on or about April 13, 2017, and said appeal having been perfected, And petitioner-appellant having moved for a calendar preference in hearing of the appeal, and for a stay enjoining respondent from delaying or interfering with expedited determination of the appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of granting a preference in hearing the appeal for the November 2017 Term, in accordance with the stipulation of the parties dated August 4, 2017, and to which Term the appeal has been calendared. The motion is otherwise denied, as academic.
