DECISION & ORDER ON MOTION
Appeals from an order of the Supreme Court, Nassau County, dated October 6, 2020, and a judgment of the same court dated January 14, 2021. Motion by the respondent, inter alia, to direct the appellant to serve and file a supplemental appendix containing certain material and to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to direct the appellant to file a supplemental appendix is granted to the extent that, on or before January 17, 2022, the appellant shall serve and file, via NYSCEF, a supplemental appendix containing the following material: the entire transcripts of the proceedings on May 15, 2019, June 3, 2019, June 19, 2019, June 20, 2019, August 6, 2019, and August 8, 2019, and pages 2-122 and 128-169 of the transcript of the proceeding held on May 14, 2019, pages 2-41 and 45-91 of the transcript of the proceeding held on May 16, 2019, pages 2-174 and the remaining missing pages of the transcript of the proceeding held on May 22, 2019, pages 10-155 of the transcript of the proceeding held on May 23, 2019, pages 2-14, 65-82, and 84-87 of the transcript of the proceeding held on June 4, 2019, pages 19-122 and 130-131 of the transcript of the proceeding held on June 5, 2019, pages 3-64 and 70-145 of the transcript of the proceeding held on June 13, 2019, pages 2-66, 69-76, and 101-127 of the transcript of the proceeding held on June 17, 2019, pages 10-65 of the transcript of the proceeding held on June 18, 2019, pages 83-161 of the transcript of the proceeding held on August 2, 2019, and pages 2-17 and 31-99 of the transcript of the proceeding held on August 5, 2019, and that branch of the motion is otherwise denied; and it is further,
ORDERED that branch of the motion which is to extend the time to serve and file a brief is granted, and on or before February 16, 2022, the respondent shall serve and file the respondent's brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website; and it is further, ORDERED that the motion is otherwise denied.
