K.E.B., Appellant v. OFFICE OF THE ATTORNEY GENERAL OF TEXAS AND D.R.A.,Appellees
On Appeal from the 170th District Court McLennan County, Texas Trial Court Cause No. 2022-3571-4
Panel consists of Chief Justice Christopher and Justices Spain and Poissant.
ORDER
PER CURIAM
On August 22, 2024, this court issued an opinion dismissing this appeal for lack of a final, appealable order.
On September 3, 2024, appellant K.E.B. filed an amended motion for rehearing asking this court to grant rehearing, order the referring trial court to provide a clarification regarding the "unauthorized court order signed by the associate judge," vacate the illegal or unauthorized court order, and order a refund of child support payments.
On September 5, 2024, appellee Office of the Attorney General of Texas ("OAG") also filed a motion for rehearing asking this court to withdraw its opinion, abate the appeal, and order the referring trial court to modify its final order and then ultimately reinstate the appeal.
Both K.E.B.'s and OAG's motions for rehearing are denied. However, the court recognizes the time and expense involved in filing an appeal and briefing it for submission. Once the mandate issues in case number 14-23-00797-CV, the court will consider a motion to file the record and briefs in case number 14-23-00797-CV in a new appeal and to set that appeal for submission if the parties agree that no additional briefing is required.
