Pursuant to Rule 41(a) of the Federal Rules of Civil Procedure, William Kearnes and Defendant identified as Capital One Bank (USA), N.A., properly identified as Kohl's Inc. (“Defendant”), stipulate to dismiss Plaintiff's claims against Defendant without prejudice.
