MARVIN KAY, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan, Chief Judge

On August 10, 2023, respondent filed a Motion for Continuance, advising that Warren N. Nemiroff-counsel for petitioner in this case-had recently died. By Order served August 16, 2023, the Court granted the Motion for Continuance.

A subsequent review of the State Bar of California website confirms that Mr. Nemiroff's status is listed as "Deceased," and a telephone call placed to the telephone number listed in the Court's records for Mr. Nemiroff results in an automated message advising that the number is no longer in service. In view of the foregoing, we will withdraw Mr. Nemiroff from this case.

Upon due consideration and for cause, it is

ORDERED that Warren N. Nemiroff is withdrawn as counsel for petitioner in this case.
