On February 22, 2023, respondent filed a status report in which he states that he is continuing to prepare a motion to dismiss this case for lack of jurisdiction in light of the opinion of the U.S. Court of Appeals for the D.C. Circuit in Li v. Commissioner, 22 F.4th 1014 (D.C. Cir. 2022).
In consideration of the foregoing, it is, ORDERED that respondent shall file, on or before March 24, 2023, an appropriate motion or a status report detailing the then-present status of the case.
