Belinda M. Kasmiersky v. Suzanne P. Kornblit

ORDER Trial court case number: 13-CPR 026038 Trial court: County Court at Law No 2 of Fort Bend County

This is an appeal from an order appointing a receiver, signed on March 16, 2018. Appellant filed a notice of appeal on March 20, 2018.

An interlocutory order appointing a receiver is appealable under Section 51.014. See TEX. CIV. PRAC. & REM. CODE § 51.014(a)(1). Appeals from interlocutory orders are accelerated. See TEX. R. APP. P. 28.1(a). When a party files an accelerated appeal, the notice of appeal must state that the appeal is accelerated. See TEX. R. APP. P. 25.1(d)(6). Appellant's notice of appeal does not state that this is an accelerated appeal.

The court directs appellant to file a response within 10 days of the date of this order concerning whether the order appealed is a final judgment or an interlocutory order and whether this appeal should be reclassified as an accelerated appeal.

It is so ORDERED. Judge's signature: /s/ Jennifer Caughey
