Present — Dowling, P.J., Merrell, Martin, O'Malley and Proskauer, JJ.


Judgment reversed as against the defendant, appellant, and new trial ordered as to said defendant, with costs to appellant to abide the event, upon the ground that the verdict against the defendant, appellant, was against the weight of the credible evidence, and upon the further ground of error in the charge, the court having charged in effect that the vehicles of both defendants had the right of way.
