MEMORANDUM OPINION NUNC PRO TUNC

On May 18, 2006, appellant filed a notice of appeal in this case. Appellant's brief was due on July 7, 2006. When appellant had not filed his brief by August 7, 2006, we sent a letter to appellant directing him to file his brief within ten days or the appeal would be subject to dismissal. Nevertheless, to date, appellant has not filed his brief or otherwise communicated with this Court regarding this appeal.

Accordingly, we DISMISS the appeal. See Tex. R. App. P. 38.8(a)(1), 42.3(c).
