This case is scheduled for trial at the remote session of the Court scheduled to commence on December 12, 2022, for Baltimore, Maryland. On November 14, 2022, petitioner filed a Motion for Continuance (Doc. 46). In the Motion, petitioner states, among other things, that as of October 26, 2022, he has "not become of receipt of the stipulated documents IRS Counsel is proposing. . . [or] of the copy of the complete IRS administrative file." Petitioner further states that not having these documents "prevents [him] proceeding to trial in a timely fashion." Respondent's Pretrial Memorandum (Doc. 47) filed November 21, 2022, states that respondent does not object to the granting of petitioner's Motion.
The Motion for Continuance does not inform the Court of what stipulated documents are purportedly due to petitioner for the prosecution of his case. Likewise, as directed in the Court's Standing Pretrial Order, served on the parties on August 8, 2022, motions related to discovery or stipulations are neither pending nor have been timely filed in this case, and the parties must file a Stipulation of Facts by November 28, 2022. The Court notes that petitioner's request in the pending Motion is similar to petitioner's January 28, 2020, Motion for Continuance (Doc. 8), which the Court granted, and subsequently remanded this case to respondent's Office of Appeals. Accordingly, we are not inclined to further delay the trial or disposition of this case.
Petitioner is reminded that the Court has compiled a list of local tax clinics that may provide important advice and assistance to self-represented parties who have disputes with the IRS. These attorneys are listed on the Court's website (www.ustaxcourt.gov), and are attached to the August 8, 2022, Notice of Trial.
Upon due consideration, it is
ORDERED that this case is set for a status report hearing at the calendar call of the remote session of the Court scheduled to commence on December 12, 2022, for Baltimore, Maryland, at 10:00 AM (ET) during which the parties shall inform the Court of the then-present status of this case and their preparations for trial. The Court expects the parties to work cooperatively and expeditiously to prepare the case for trial. The parties shall refer to the Notice of Trial for the Zoomgov Meeting ID and Passcode.
