Appellant, Ramesh Kapur, has filed a notice of appeal from the trial court's November 13, 2023 "Interlocutory Order Granting Defendant's Traditional and No Evidence Motion for Summary Judgment." Based on the appellate record, it appears that the Court lacks jurisdiction over the appeal.
This Court generally has jurisdiction only over appeals from final judgments and specific interlocutory orders that the legislature has designated as appealable orders. See CMH Homes v. Perez, 340 S.W.3d 444, 447-48 (Tex. 2011); see also Tex. Civ. Prac. & Rem. Code § 51.014. Our review of the record does not indicate that appellant has appealed from a final judgment or an otherwise appealable order.
The appellate record indicates that on November 13, 2023, the trial court entered the order challenged by appellant. In that order, the trial court expressly stated that the order was "interlocutory," and that "[o]ther claims involving other parties remain pending in this lawsuit."
The Court therefore orders appellant to file a written response, with citation to law and the record, demonstrating that this Court has appellate jurisdiction over this appeal from the trial court's order interlocutory summary judgment order. Failure to respond will result in dismissal of the appeal for lack of jurisdiction. See Tex. R. App. P. 42.3(a), 43.2(f). Appellant's response is due in this Court within ten days of the date of this order. Appellee's reply, if any, is due within ten days the date of appellant's response is filed.
