This case is scheduled for trial at the session of the Court scheduled to commence on April 24, 2023, in New York, New York. On April 3, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute.

Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute, is set for hearing at the calendar call of the aforementioned session of the Court, at 10:00 AM (ET). Petitioner is advised that failure to comply with the terms of this Order or failure to appear at the hearing on April 24, 2023, may result in the Court granting respondent's motion and entering an order and decision against petitioner. It is further

ORDERED that, in addition to regular service, the Clerk of the Court shall serve a copy of this Order on petitioner at the alternative address listed on the Certificate of Service attached to respondent's aforementioned Motion to Dismiss.
