Present — Martin, P.J., Townley, Untermyer, Dore and Cohn, JJ.


Order unanimously modified to the extent of staying the trial provided the interrogatories and cross interrogatories provided for in the stipulation shall be complete by June 30, 1943, and provided as stipulated that in the event of defendant's death the deposition may be read and the defendant waives the provisions of section 347 of the Civil Practice Act, and, as so modified, affirmed. No opinion. Settle order on notice.
