ORDER

The motion for immediate consideration is GRANTED. The motion to file a reply to the answer is GRANTED and the reply is considered.

The motion to dismiss pursuant to MCR 7.211(C)(2) is GRANTED for the reason that the appeal is not within the Court of Appeals jurisdiction because the trial court's order did not deny summary disposition on the basis of governmental immunity. MCR 7.202(6)(a)(v).
