ORDER

Giving due regard to the representations contained in respondent's motion to dismiss for lack of prosecution, filed March 2, 2023, it is

ORDERED that respondent's motion is set for hearing when the case is called from the calendar at the time, date and place shown in the Notice Setting Case for Trial, served December 6, 2022. It is further

ORDERED that in addition to regular service on the parties, the Clerk of the Court serve a copy of this Order on petitioner at 217 S. Raleigh, Denver, CO 80219. It is further

ORDERED that the Clerk of the Court reserve the above-referenced Notice Setting Case for Trial on petitioner at the address shown in the preceding paragraph. It is further

ORDERED that upon receipt of this Order, petitioner notify the Court of his current mailing address. See Form 10 in the Appendix to the Tax Court Rules of Practice and Procedure, available on the Internet at www.ustaxcourt.gov.

Petitioner is advised that the failure to appear at the hearing could result in the dismissal of the case and entry of decision as requested in respondent's motion.
