On order of the Court, a stipulation signed by the attorneys for the parties agreeing to the dismissal of the application for leave to appeal in this matter is considered and it IS ORDERED that the application for leave to appeal is DISMISSED with prejudice and without costs. The motions for immediate consideration and for stay are dismissed as moot.
