This is a companion appeal to Oubre v. Judice et al., 147 So.2d 745. For the reasons therein set forth, the trial court's judgment dismissing plaintiff's suit against the defendant is affirmed; plaintiff-appellant to pay all costs of this appeal and of these proceedings.

Affirmed.

On Application for Rehearing.
