ORDER


After making an independent review of the pleadings, files and records in this case, and the Findings, Conclusions and Recommendation of the United States Magistrate Judge, filed February 7, 2002, the court concludes that the findings and conclusions of the United States Magistrate Judge are correct, and they hereby are accepted as those of the court. This action therefore is dismissed without prejudice, for failure to prosecute pursuant to Fed.R.Civ.P. 41(b).

It is so ordered.

JUDGMENT

This judgment is issued pursuant to the court's order and findings dated April 8, 2002.

It therefore is ORDERED, ADJUDGED, and DECREED that this action hereby is dismissed without prejudice, for failure to prosecute pursuant to Fed.R.Civ.P. 41(b).

It further is ORDERED that the clerk shall transmit a copy of this judgment and a copy of the court's order of April 8, 2002 accepting the Findings, Conclusions and Recommendation of the United States Magistrate Judge to Petitioner and Respondent.
