Opinion

No. 08-P-949.

September 22, 2009.

Decisions Pursuant to Rule 1:28.

We affirm the judgments as to the liability of Sullivan to J.R.J. for J.R.J.'s properly asserted extra work claims and attorney's fees. However, so much of the judgment pertaining to the amount of damages is vacated and the matter remanded to the Superior Court for a recalculation not inconsistent with the memorandum and order of the Appeals Court.
