ORDER JUDGMENT BASED ON SETTLEMENT STIPULATION


BASED UPON THE WRITTEN STIPULATION OF THE PARTIES dated May 22, 2003, and for good cause appearing,

IT IS HEREBY ORDERED ADJUDGED and DECREED:

1. The terms of the settlement of the parties are approved and accepted by the Court.

2. Plaintiffs' claim for money damages as against defendants is dismissed.

3. In lieu of an award of attorney fees and court costs under 42 U.S.C. § 1983 and § 1988 defendants shall pay to the plaintiffs, for the use and benefit of plaintiffs' counsel the sum twenty-three thousand dollars ($23,000.00). That sum shall be paid to plaintiffs' counsel on or before June 11, 2003. If not paid by that date, defendants shall pay the additional sum of one thousand dollars ($1,000.00) plus statutory post-judgment interest retroactive from May 22, 2003 until the total is paid.

4. The Court shall maintain jurisdiction for the purpose of enforcing the agreement and this order.

5. The case is hereby dismissed with prejudice with the proviso that any party on application may seek to vacate this order and reopen this case upon failure of any party to comply with the terms and conditions of the settlement agreement.
