Joyner v. State

District Court of Appeal of Florida, Fourth District
Dec 28, 1989
554 So. 2d 32 (Fla. Dist. Ct. App. 1989)

Opinion

No. 88-1599.

December 28, 1989.

Appeal from the Circuit Court for Broward County; M. Daniel Futch, Jr., Judge.

Richard L. Jorandby, Public Defender, and Margaret Good, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and James J. Carney, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm all of the appellant's convictions except for the possession of a firearm while engaged in a criminal offense conviction, which the state appropriately concedes to be duplicitous of appellant's conviction for attempted first-degree murder and which we reverse.

GLICKSTEIN, GUNTHER and STONE, JJ., concur.
