Appellant's brief is overdue. The brief was originally due July 22, 2024. On July 30, 2024, this Court granted appellate counsel Mitchell Nolte's first motion for extension of time to file the brief, and we ordered Mr. Nolte to file appellant's brief on or before August 22, 2024. On August 26, 2024, this Court granted Mr. Nolte's second motion for extension of time to file the brief, and we ordered Mr. Nolte to file appellant's brief on or before September 27, 2024. As of the date of this order, appellant's brief has not been filed.
We ORDER Mr. Nolte to file appellant's brief and a motion for extension of time to file the brief on or before OCTOBER 17, 2024. If appellant's brief and a motion for extension of time to file the brief are not filed by the above date, the court may abate the appeal and order the trial court to hold a hearing and make findings pursuant to Texas Rule of Appellate Procedure 38.8(b)(2). See Tex. R. App. P. 38.8(b)(2), (3).
We DIRECT the Clerk to send copies of this order to the Honorable Tom Nowak, Presiding Judge, 366th Judicial District Court; and counsel for all parties.
