Present — Close, P.J., Hagarty, Carswell, Taylor and Lewis, JJ.


Action to set aside a deed to real property, to have the mortgagor declared the owner thereof, to have the plaintiff's second mortgage, the lien of which had been extinguished through the foreclosure of a first mortgage, revived and declared a valid lien upon the premises, and for judgment of foreclosure. Judgment, in so far as appealed from, unanimously affirmed, without costs, on the authority of Dorff v. Bornstein ( 277 N.Y. 236).
