On April 11, 2024, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. This case was called from the calendar of the Court's New Orleans, Louisiana, trial session, on May 6, 2024. Petitioner and counsel for respondent appeared and were heard. At calendar call, the parties informed the Court that a basis for settlement has been reached. We took the pending motion to dismiss under advisement because petitioner appeared but computations were required. Respondent now has filed a Motion for Entry of Decision detailing counsel's efforts to obtain a signed decision document from petitioner. To date he has not responded.

ORDERED that, on or before September 26, 2024, petitioner shall file a response to respondent's Motion for Entry of Decision, filed August 22, 2024.

Petitioner is warned that if he fails to respond by September 26, 2024, we will grant respondent's motion and enter decision.
