This matter comes before the Court upon the unopposed affidavit of the plaintiffs, Joseph Stong, Inc., and Neil Stong, for an award of costs and reasonable attorneys' fees pursuant to the grant of summary judgment entered against the defendant, Mark B. Boyd, Commissioner of the State of New Jersey, Department of Labor; and the Court having reviewed the plaintiffs' affidavit; and having held a telephone conference on April 30, 2003; and for good cause shown;
IT APPEARING TO THE COURT that on March 26, 2003, this Court entered an Order granting the plaintiffs' motion for summary judgment against the defendant and denying the defendant's cross-motion for summary judgment and directing the plaintiffs to submit an affidavit of costs and reasonable attorneys' fees incurred in this matter on or before April 7, 2003, and directing that the defendant submit any response thereto within ten (10) days thereafter; and
IT FURTHER APPEARING TO THE COURT that the plaintiffs filed their affidavit of costs and reasonable attorneys' fees on April 7, 2003, in the amount of $69,201.52, consisting of $6,674.02 in costs and expenses and $62,527.50 in attorneys' fees; and
IT FURTHER APPEARING TO THE COURT that the defendant never submitted any response to the plaintiffs' affidavit of costs and reasonable attorneys' fees and the defendant having indicated to the Court during the April 30, 2003, telephone conference that the defendant does not oppose the plaintiffs' affidavit of costs and reasonable attorneys' fees; and
THE COURT finding that the plaintiffs have incurred $69,201.52 in costs and reasonable attorneys' fees in obtaining a grant of summary judgment against the defendant;
IT IS this day of 30th, day of April, 2003 hereby;
ORDERED that the plaintiffs' affidavit of costs and reasonable attorneys' fees is GRANTED; and it is further
ORDERED that $69,201.52 in costs and reasonable attorneys' fees shall be assessed against the defendant.
