MOTION DECISION

DECISION AND ORDER ON MOTION

Motion to reargue motion for permission to appeal from order of Montgomery County Family Court dated February 10, 2021, for order finding that respondent has an automatic right to appeal and for stay pending appeal.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion to reargue the motion for permission to appeal is granted, without costs, and so much of this Court's order, entered June 3, 2021, as denied the motion for permission to appeal is vacated, and it is further

ORDERED that the motion for an order finding that respondent has an automatic right to appeal is denied, without costs, and it is further

ORDERED that the motion for a stay pending appeal is referred to Justice Lynch, who makes the following decision: Motion denied, without costs.
