J.O.S. v. State

District Court of Appeal of Florida, First District
Apr 5, 1993
616 So. 2d 184 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-3222.

April 5, 1993.

An appeal from the Circuit Court for Duval County; John Skinner, Judge.

Nancy A. Daniels, Public Defender, Chris W. Hoeg, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., Gypsy Bailey and Michelle Konig, Asst. Attys. Gen., Tallahassee, for appellee.

Appellant appeals the denial of his motion to dismiss a delinquency petition charging escape from a juvenile facility in violation of section 39.112, Florida Statutes (1989). Finding this issue to be identical to that in R.A.H. v. State, 614 So.2d 1189 (Fla. 1st DCA 1993), we reverse.

MINER and WOLF, JJ., concur.
