Opinion

No. 89-72.

October 19, 1989.

An Appeal from the Circuit Court for Santa Rosa County; Ben Gordon, Judge.

Michael E. Allen, Public Defender, and Phil Patterson, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., and Virlindia A. Sample, Asst. Atty. Gen., Tallahassee, for appellee.

This cause is before us on appeal of appellant's conviction for resisting arrest with violence. After careful consideration of the merits, we affirm. In light of the State's concession that appellant is entitled to a hearing on imposition of costs, we remand for that purpose only.

BOOTH, JOANOS and BARFIELD, JJ., concur.
