Upon consideration of Respondent, John Banister's Motion to Dismiss filed in the above cause, is granted in part and denied in part. The Motion to Dismiss is hereby granted and it is ordered that the Notice to Invoke Discretionary Jurisdiction be and the same is hereby dismissed. The Motion for Awarding Attorney's Fees to Respondent is hereby denied.
