Before the Court is appellant's January 14, 2022 fifth motion for extension of time to file his brief. Appellant requests an extension until February 12 and explains the extension is necessary so that counsel, who he expects to retain by January 21, may have an opportunity to prepare and file the brief.

Although we cautioned appellant when we granted his fourth extension that further extensions would not be granted and the appeal might be dismissed if the brief was not filed, we GRANT the extension in light of the circumstances. We again caution, however, that additional extension requests will not be granted and failure to file the brief by February 14, 2022, see Tex. R. App. P. 4, may result in dismissal of the appeal without further notice. See Tex. R. App. P. 38.8(a), 42.3(b), (c).
