MEMORANDUM OPINION

ROBERT D. BURNS, III CHIEF JUSTICE

Before the Court is appellant's motion for voluntary dismissal. In the motion, appellant asks that we render judgment effectuating the parties' settlement agreement. Signed copies of the parties' Settlement and Compromise Agreement and Release of Default Judgment are attached to the motion. We grant the motion to the extent that we order appellant to file the Release of Default Judgment with the trial court and dismiss the appeal. See TEX. R. APP. P. 42.1(a)(2)(A).

JUDGMENT

Justices Pedersen, III and Carlyle participating.

In accordance with this Court's opinion of this date, we ORDER appellant to file the Release of Default Judgment with the trial court and DISMISS the appeal.

We ORDER that the parties bear their own costs of this appeal.
