JAMES JONES, Appellant v. THE STATE OF TEXAS, Appellee
From the 13th District Court Navarro County, Texas
Trial Court No. D34884-CR
ORDER
Appellant's brief was originally due on July 18, 2017. A first extension of time of 31 days was granted, and appellant's brief was due August 18, 2017. A second extension of time of 31 days was granted, and appellant's brief was due September 18, 2017. A third extension of time of 30 days was granted, and appellant's brief was due October 18, 2017. Now, counsel for appellant has requested an additional 7 days which would have made the brief due on October 25, 2017. We waited to see if the brief would be filed as requested. It was not. This most recent request would have pushed the total days to file the brief to 122 days to file a brief that the Rules of Appellate Procedure provide should be filed in 30 days. We cannot, in good conscience, grant counsel 4 times the amount of time allowed by the rules to file appellant's brief without some showing of good cause other than being busy.
Accordingly, appellant's fourth Motion to Extend Time to File Appellant's Brief is denied. Appellant's brief is due November 15, 2017. If not filed by the deadline set herein, the appeal will be abated for a hearing pursuant to Rule 38.8(b) of the Texas Rules of Appellate Procedure.
