Opinion

No. 2D97-3436.

Opinion filed June 21, 2000.

Appeal from the Circuit Court for Polk County; Cecelia Moore, Judge.

James Marion Moorman, Public Defender, and Richard J. Sanders, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Susan D. Dunlevy, Assistant Attorney General, Tampa, for Appellee.

We affirm the judgment of conviction on appeal in this case. We remand for reconsideration of sentence, however, because the offense was committed on August 23, 1996. See Smith v. State, 25 Fla. L. Weekly D1273 (Fla. 2d DCA May 24, 2000).
