Jones v. McNeil

District Court of Appeal of Florida, First District
Nov 2, 2010
46 So. 3d 1156 (Fla. Dist. Ct. App. 2010)

Opinion

No. 1D10-2012.

November 2, 2010.

Appeal from an order of the Circuit Court for Leon County. Judge Jackie Lee Fulford.

Robert L. Jones, pro se, Appellant.

Bill McCollum, Attorney General, and Maricruz Rahaman, Assistant Attorney General, Tallahassee, for Appellee.

Because the circuit court disposed of the petition for writ of mandamus filed below on procedural grounds rather than the merits, we treat this proceeding as an appeal. The order dismissing the petition for writ of mandamus for failure to exhaust administrative remedies is AFFIRMED.

WEBSTER, DAVIS, and ROWE, JJ., concur.
