ORDER
Before the Court is an appeal from a decision of the Unemployment Insurance Appeals Board (the "Board"). The Appellant, Freddie L. Jones, has appealed the denial of his unemployment benefits by the Board. At the hearing, the Board found that there was substantial evidence to support the Employer-Appellee's position that Mr. Jones stole items from the employer, thus warranting his dismissal for just cause. Neither Appellant, nor Appellee, Kirby Holloway Restaurant, filed briefs in the instant matter despite having an opportunity to do so, and the Court is prepared to render a decision on the pleadings. This Court finds that there was substantial evidence before the Board to justify its decision.
Therefore, from the record below, it appears that the Board was correct in finding that there was substantial evidence before it to determine that the Appellant was discharged from his employment for just cause in connection with his work and in denying Appellant unemployment benefits commencing the week in which he was discharged.
