Appellant having moved for an extension of time to perfect the appeals taken herein from orders of the Supreme Court entered in the Office of the Clerk of the County of Erie on August 10, 2012, and November 9, 2012,

Now, upon reading and filing the affidavits of Daniel Jones sworn to December 20, 2013, and December 28, 2013, the notice of motion with proof of service thereof, the affirmation of Jeremy C. Toth, Esq., dated December 26, 2013, and the affidavit of Patricia L. Fulwilers, Esq., sworn to November 7, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed without prejudice to a motion to vacate dismissal of the appeals (see 22 NYCRR 1000.13 [g]).
