This case is presently calendared for trial at the Court's February 5, 2024, New York, New York, trial session.
On January 4, 2024, the Commissioner filed a Motion to Dismiss for Lack of Prosecution. In the Commissioner's motion to dismiss, he stated that Ms. Jones had been nonresponsive to his communication attempts to resolve this case. On January 9, 2024, the Commissioner filed a Motion for Continuance. In this motion, counsel for the Commissioner states that Ms. Jones contacted him on January 9, 2024, to discuss the pending case. The motion further states that Ms. Jones represented to counsel that she has received counsel's prior calls and emails but requested additional time to provide counsel with documents and to discuss a potential resolution of the case.
Upon due consideration of the Commissioner's motions and for cause, it is
ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on February 5, 2024. It is further
ORDERED that the Commissioner's Motion to Dismiss for Lack of Prosecution, filed January 4, 2024, is taken under advisement. It is further
ORDERED that the Commissioner's Motion for Continuance, filed January 9, 2024, is granted, and this case is continued. It is further
ORDERED that the undersigned retains jurisdiction of this case. It is further
ORDERED that, on or before February 16, 2024, the parties shall file a joint status report (or separate reports, if expedient) to inform the Court of the then-present status of this case, or a proposed stipulated decision.
