On order of the Court, the application for leave to appeal from the September 29, 2000 decision of the Court of Appeals, the motion for immediate consideration, and the motion for stay are considered. The motion for immediate consideration is GRANTED. The motion for stay of proceedings is GRANTED pending the further consideration of the application for leave to appeal.

Cavanagh and Kelly, JJ., would grant immediate consideration but would deny a stay of proceedings.
