Jones v. Brinsmade

Appellate Division of the Supreme Court of New York, First Department
May 1, 1905
104 App. Div. 619 (N.Y. App. Div. 1905)

Opinion

May, 1905.

Present — Van Brunt, P.J., O'Brien, Ingraham, McLaughlin and Hatch, JJ.

Order affirmed, with ten dollars costs and disbursements.

No question having been raised upon the argument of this appeal as to the amount awarded for alimony and counsel fee, that question is not before us. We think, however, that for the reasons stated in the opinion in the case of Gore v. Gore ( 103 App. Div. 74) the court had power to make the order, and it should be affirmed, with ten dollars costs and disbursements.
