Upon due consideration of the Motion for Summary Judgment, filed June 16, 2023, and the Motion for Leave to File Amicus Brief in Support of Petitioner, filed August 18, 2023, it is

ORDERED that the above-referenced motions are calendared for hearing at the trial session of the Court scheduled to commence on January 8, 2024, in the Alexander Hamilton U.S. Custom House, One Bowling Green, Courtroom 610, 6th Floor, New York, New York 10004, at a time and date certain of 1:00 PM on Tuesday, January 9, 2024.
