APPEAL from a judgment of the circuit court for Milwaukee county: MICHAEL T. SULLIVAN, Circuit Judge. Affirmed.

For the appellants there was a brief by Walter J. Mattison, city attorney, and Richard F. Maruszewski and Harvey G. Odenbrett, assistant city attorneys, and oral argument by Mr. Odenbrett and Mr. Maruszewski.

For the respondents there were briefs by Erwin V. Novotny, attorney, and Richard L. Novotny of counsel, both of Milwaukee, and oral argument by Richard L. Novotny.


The facts and issues are the same as in Grand View School Dist. v. Milwaukee, ante, p. 76, 90 N.W.2d 103, except that the common school district, one of the respondents herein, is already a joint district rather than one which is prospectively joint by reason of pending annexations having priority over a consolidation.

The judgment from which the appeal is taken declared that consolidation of the town of Granville and the city of Milwaukee did not change the boundaries of the respondent joint district and it ordered the return of the school building by the city to the joint district.


This appeal is controlled by the decision in Grand View School Dist. v. Milwaukee, supra. The precedents and conclusions of this court in that case require the judgment to be affirmed.
