Matthew JOINER, Appellant v. The STATE of Texas, Appellee

From the 186th Judicial District Court, Bexar County, Texas
Trial Court No. 2014CR10594
Honorable Jefferson Moore, Judge Presiding

ORDER

The reporter's record was originally due to be filed in this appeal on February 17, 2017. The portion of the reporter's record to be filed by Ms. Roxanne Pena was filed on January 11, 2017. Ms. Debra Doolittle is the court reporter responsible for preparing the remaining portion of the reporter's record.

By order dated March 3, 2017, Ms. Doolittle's request for an extension of time was granted, extending the deadline to file the record to April 17, 2017. Because the reporter's record was not filed by the extended deadline, this court sent written notice on April 20, 2017, reminding Ms. Doolittle that the record was late. Ms. Doolittle was instructed to file the reporter's record no later than May 22, 2017. In response to this notice, Ms. Doolittle contacted the court on April 24, 2017, and informed the court she would file her portion of reporter's record no later than May 22, 2017. Ms. Doolittle's portion of the reporter's record has not been filed.

It is therefore ORDERED that Ms. Doolittle file her portion of the reporter's record in this court no later than June 9, 2017. If the record is not received by such date, an order will be issued directing Ms. Doolittle to appear and show cause why she should not be held in contempt for failing to file the record. The clerk of this court shall cause a copy of this order to be served on Ms. Doolittle by certified mail, return receipt requested, or give other personal notice of this order with proof of delivery. Because "[t]he trial and appellate courts are jointly responsible for ensuring that the appellate record is timely filed," TEX. R. APP. P. 35.3(c), the clerk of the court is directed to serve a copy of this order on the Honorable Jefferson Moore, Judge of the 186th Judicial District Court.
