KIYEL JUSTIN JOHNSTON, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Kathleen Kerrigan, Chief Judge.

By Order served October 6, 2022, the Court directed petitioner to file an amended petition and to pay the Court's filing fee. On October 13, 2022, the Court waived the filing fee for petitioner. On November 17, 2022, petitioner filed an Application for Waiver of Filing Fee. No amended petition has been received by the Court. However, upon further review of the record, it appears that an amended petition is not necessary.

Upon due consideration of the foregoing, it is ORDERED that petitioner's Application for Waiver of Filing Fee is denied as moot. It is further ORDERED that petitioner is no longer required to file an amended petition. It is further ORDERED that, on or before January 17, 2023, respondent shall file an answer to the petition.
