Opinion

No. 205, 2006.

Submitted: July 10, 2006.

Decided: August 15, 2006.

Superior Court of the State of Delaware, in and for New Castle County, C.A. No. 06M-02-056.

Before STEELE, Chief Justice, JACOBS, and RIDGELY, Justices.

ORDER

This 15th day of August 2006, after careful consideration of Ronald Johnson's opening brief and the State's motion to affirm, we find it manifest that the judgment of the Superior Court denying Johnson's petition for a writ of habeas corpus should be affirmed on the basis that Johnson's detention by federal authorities cannot be remedied by a writ of habeas corpus under 10 Del. C. § 6902(3).

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
