Joseph Johnson, Petitioner-Appellant, v. Westin New York at Times Square, et al., Respondents-Respondents.


An appeal having been taken to this Court from the judgment of the Supreme Court, New York County, entered on or about September 28, 2015, and said appeal having been perfected, And respondent-respondent, Westin New York at Times Square, having moved for leave to strike the record on appeal, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,It is ordered that the motion is granted to the extent of striking the appendix in its entirety, and directing petitioner to file a new appendix omitting pages A56-A236 of the present appendix. Petitioner is also directed to include a complete copy of respondent Westin's Verified Answer, dated May 27, 2015, (inclusive of pp. 2-5 also in the new appendix), on or before December 4, 2017 for the February 2018 Term, to which Term the appeal is adjourned.
