Johnson v. State

District Court of Appeal of Florida, First District
Apr 4, 1995
652 So. 2d 951 (Fla. Dist. Ct. App. 1995)

Opinion

No. 94-1010.

April 4, 1995.

Appeal from the Circuit Court, Santa Rosa County, Paul Rasmussen, J.

Kenneth L. Brooks, Jr. of Clay, Fitzgerald Brooks, P.A., Milton, for appellant.

Robert A. Butterworth, Atty. Gen., Thomas Crapps, Asst. Atty. Gen., Tallahassee, for appellee.

We find no error in the trial court's denial of credit against a sentence of incarceration for pretrial time spent on house arrest. See Fernandez v. State, 627 So.2d 1 (Fla. 3d DCA 1993), rev. denied, 639 So.2d 977 (Fla. 1994); Valencia v. State, 645 So.2d 1085 (Fla. 3d DCA 1994).

ERVIN, MINER and WOLF, JJ., concur.
