Johnson v. State

District Court of Appeal of Florida, Fourth District
May 9, 2001
784 So. 2d 550 (Fla. Dist. Ct. App. 2001)

Opinion

No. 4D00-2425.

Opinion filed May 9, 2001.

Appeal from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Paul L. Backman, Judge; L.T. Case No. 97-9721CF10A.

Carey Haughwout, Public Defender, and Tatjana Ostapoff, Assistant Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Kristine Keaton, Assistant Attorney General, Fort Lauderdale, for appellee.

We affirm appellant's sentence for armed robbery but remand for correction of a clerical error in the judgment of conviction, so that it reflects that the conviction was for robbery with a firearm rather than robbery with a deadly weapon.

Dell, Gunther and Klein, JJ., Concur.
