Xavier Johnson v. The State of Texas

Trial court: 278th District Court of Madison County No. 18-12999

ORDER

Veronica Rivas-Molloy, Judge

On November 3, 2022, the reporter's record was filed in this case. Four exhibits were not included in the reporter's record filed in this Court:

• State's No. 5 (surveillance video);
• State's No. 31 (audio interview);
• Defense No. 1 (video interview); and
• Defense No. 1-A (redacted video).

Texas Rule of Appellate Procedure 34.6(d) addresses supplementation of the reporter's record. The rule states:

If anything relevant is omitted from the reporter's record, the trial court, the appellate court, or any party may by letter direct the official court reporter to prepare, certify, and file in the appellate court a supplemental record containing the omitted items. Any supplemental reporter's record is part of the appellate record.
Tex. R. App. P. 34.6(d).

In light of the above, we hereby order the court reporter to file, within seven days of the date of this order, a supplemental reporter's record containing the four above-referenced exhibits. The Clerk of this Court is directed to cooperate with the trial court, as appropriate, to provide for the safekeeping, transportation, and return of the original exhibits.

It is so ORDERED.
