THOMAS LINZ JOHNSON, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the 282nd Judicial District Court Dallas County, Texas Trial Court Cause No. F15-58525-S
ORDER
ROBERT D. BURNS, III, CHIEF JUSTICE
On February 2, 2022, the Texas Court of Criminal Appeals granted appellant an out of time appeal and ordered the trial court to appoint counsel to represent him on appeal. On February 28, 2022, Bradrick Collins filed a notice of appeal stating he was the attorney of record for appellant. The clerk's record, filed May 11, 2022, lists Michael Casillas as counsel for appellant, and OnBase shows Mr. Casillas was appointed on March 23, 2022. Because both attorneys have filed notices of appeal on behalf of appellant, it is unclear who represents him on appeal.
We ORDER the trial court to conduct a hearing to determine whether appellant is represented by Mr. Collins or Mr. Casillas. We ORDER the trial court to transmit the record, if any, of the hearing, including findings of fact, any orders, and any supporting documentation, to this Court within THIRTY DAYS of the date of this order.
We DIRECT the Clerk to send copies of this order to the Honorable Amber Givens, Presiding Judge, 282nd Judicial District Court; Michael Casillas; Bradrick Collins; and the Dallas County District Attorney's Office.
We ABATE the appeal to allow the trial court to comply with the order. The appeal will be reinstated thirty days from the date of this order or when the findings are received, whichever is earlier.
