The clerk's record was filed on June 8, 2023, but the reporter's record has not been filed. On May 9, 2023, the Clerk of this Court notified appellants that the court reporter responsible for preparing the record in this appeal informed the Court that the record had not been filed because appellants either (1) failed to request the reporter's record or (2) had not made arrangements to pay for the record. See Tex. R. App. P. 35.3(b). The Clerk further notified appellants that unless they caused the reporter's record to be filed in this Court, made arrangements to pay for the reporter's record, or provided proof that they are entitled to proceed without payment of costs by June 7, 2023, the Court might consider the appeal without a reporter's record. See Tex. R. App. P. 37.3(c).

On July 7, 2023, appellants filed a motion requesting an extension of time to September 15, 2023 to file the reporter's record. On August 29, 2023, the court reporter filed an information sheet stating that appellants have not made payment arrangements for the reporter's record and have not responded to messages. To date, the reporter's record has not been filed and appellants have not demonstrated that payment arrangements have been made for the reporter's record.

Accordingly, appellant's motion for an extension of time is denied. The Court will consider and decide those issues or points that do not require a reporter's record for a decision. See id. Appellants' brief is ORDERED to be filed within 30 days of the date of this order. See Tex. R. App. P. 38.6(a). Because appellants have already delayed resolution of this case, no extensions of time will be granted absent extraordinary circumstances.

It is so ORDERED.
